Flight Delay
I have a flight claim against Sata an Azores Airline for a delayed flight within the Azores
I have been told by my english solicitor that unfortunately as the airline, the departure and arrival airport of your Itinerary are not located within England or Wales we are unable to take any further action on your claim as there is no jurisdiction in the courts of England and Wales.
Is there a way round this?

The EU rules require you to make your initial claim directly with SATA. You can't claim for delays of less than three hours. If the delay was over three hours (and it wasn't caused by something outside of the control of SATA) you can claim €250. [Note that the delay time is based upon when a flight arrives at its destination, not when it takes off].
If you believe that you're entitled to that payment, but you don't receive it, then (as SATA isn't a member of an 'alternative dispute resolution' body) you can either approach the CAA's Passenger Advice and Complaints Team

Hi bigbas, as per the EC Regulation 261/2004, you can claim compensation for delayed flight only if your flight delays for more than 3 hours at the arrival airport. In order to claim compensation, your airline must have been departed from an EU airport or if you are travelling from a non-EU airport to an EU airport the operating airline should be an EU airline. As you mentioned you departed from an EU airport with SATA airlines thus you can claim compensation only if your flight has been delayed for more than 3 hours.
