my esta is granted & i have a holiday booked for usa in early december. Over the bank holiday weekend at a party for our son who is off on operations to afghan in the next few days my wife became hysterical & uncontrollable, so i slapped her to calm her down & bring her round. i was arrested, i admitted slapping her explaining why and given a simple caution for assault occassioning abh? my wife has not pressed any charges. do i now need to ry & get a visa?? if so is it likely to be granted or even completed in time?? or should i now cancel the holiday the website is confusing so any help would be appreciated

I think it would be best to let them know.The USA isnt a country I would chance it with.I should imagine as you were just given a caution and not charged that this would be in your favour.

You've been arrested. You've admitted guilt. The US London Embassy website says you should apply for a visa.

Your offence doesn't sound like moral turpitude thougn - which means that there shouldn't be a problem in getting one.

And you could still quite truthfully tick the 'no' box on the ESTA form and not worry about a visa at all. The London Embassy statement is advice, not law, and is made because they (quite rightly) don't trust the British public to understand what moral turpitude is - or to answer truthfully if they do. But you are entitled to make your own decision on the matter.

You already have your ESTA so what are you worrying about?

US Immigration won't give a monkeys what you did this weekend - nor with they have any access to this information UNLESS YOU ARE DUMB ENOUGH TO TELL THEM.
we go to the usa every year and my wife has always got in, even though she physically ,mentally and verbally abuses me all the time.. maybe i should report her to imagration as i'm entering and have her deported..

thanks for all yr replies. I wrote this withiut hubby knowing. i agree that slapping me wasn't the best option but i was completly out of it emotionally & mentally i have no recollection or memory of what went on so slapping me was the answr if it wasn't hubby some1 else would have done it to me. its the 1st time in over 20 years he's hit me & he would never ever do it again. so plesae don't think badly of him
what i don't understand is how the police knew about it?

seems more than slapping someone whos hysterical if guests felt the need to call the police.

the wife has written all of the posts. lone barman had called police due to an earlier problem, i was drunk & hysterical & have no recollection of anything. Hubby was trying to calm me. there were a lot of other things happening at the time & he wanted to get me into the car, he admitted it was arrested & has been cautioned IF I WAS AWARE & HE HAD SLAPPED ME 'BELIEVE ME HE WOULD HAVE GOT A SLAP OR WORSE BACK thanks for yr replies

Was it a caution under section 39 and for battery ? Not sure if battery is classed as a crime of moral turpitude, does anyone know ? Esta only allows you to board the plane not gurantee entry that's done by the immigration lot
