Hi I have rented a shop for the past 5 years 3 years ago the owner passed away owing me 12.500 pounds his wife said she did not have funds to pay me as her husband had other debts so I stopped paying the rent for 3 years to get some of the money owed to me back 3.500 . A couple of weeks ago she sold the shop .my lease does not end until nov 2018 the new owner has told me that she did not transfer the 500.00 deposit I had paid because I owed her rent obviously I will have to pay the rent to the ne owner is it his responsibility to recover the deposit from her.

I'm a bit confused. You rented a shop from someone, yet they ended up owing you £12,500 ?? After his wife sold the shop (assuming there's equity in the property), wouldn't she now be able to pay you whatever's outstanding?? Anyway, back to your original question, I'd guess that the answer is no, it's your responsibility to recover the deposit.

It was a furniture shop

I have been told that the deposit should of been handed over to the new owner as the disagreement is between me and the old owner
I too am confused, how did the owner of a shop you rented end up owing you £12000?

He had other properties that he had to furnish he spent a lot of time away and it mounted up I probably should of stopped supplying him.
But presumably, once this individual passed away, it was someone else or a business entity that you were depriving of your rent payments.
if the shop was his, it would have formed part of the estate and if there were creditors, it should have been sold to pay them at the time. If it wasnt his, it wouldnt have formed part of his estate and that also means you have been illegally witholding rent to the person who owns it
