Just bought some Backup and Drive Image Restore Software on Ebay. It was decribed as THIS IS ORIGINAL NEW NEVER BEEN USED. BOX OPENED TO CHECK CONTENTS ONLY
When it arrive the CD envelope had clearly been opened and when I installed it the ser number registered OK but the product activation failed. The seller still says it is new and will not refund. Do I take it to dispute on Ebay or is that a waste of time.

I think it's surprising that buying on ebay you even go the box and (from what you say) a genuine disk.

However, that aside, you may as well start the dispute on ebay as:

1/ It costs you nothing, so you've nothing to lose and you may just gain.

2/ It will alert subsequent buyers to the (possibly) dubious practices of this seller.

Persoanally I don't think you'll get a refund though. If it was lot of money, you could consider the small claims court
I would have thought that if the seller was a genuine seller then he would offer a refund on the product if it doesn't work.Sounds like the seller knew it wasn't working hence him saying he will not refund.

I don't know if you have already been in touch with the seller?.But if you explain to the seller that it isn't working & if you can't get a refund then you will have to leave neagative feedback.

The Seller is described on Ebay as a Power Seller about 600 feedback 98% .I have been in touch with the seller who said he opened the transparent CD package to see if was there but it is brand new . Ha Ha.
He is PAY Pal only with no means of getting an address as no receipt was issued.
If it was activated on another PC as I suspect that means my installation will fail doesnt it ?
