In the post today I found a summons from police. I am being done for driving at 35 mph in a 30mph zone. I don't remember seeing any speed limits in that area. First time this has happened to me as I am usually very careful. Can't believe the questions I have to fill in. Duhhh!

What are the questions?
Normally they’d give you a choice of taking the points or going to a speed awareness course. Don’t know if they’re still doing the courses with the virus going around.
Very bad luck that, Caran. You'll most likely be offered the speed awareness course instead of three points on your driving licence though.

The form is very vague. Doesn't give any options or even say what fine could be. Only says £1000 fine for not filling in and returning the form.
Is there any way that you can find out if the summons is genuine or not. There are so many scams these days I question almost everything.

maggiebee it looks genuine. But OH has just found a website that says there should be a leeway of 10% plus 2 miles that should have let me off. I might phone in the morning!
Easy to check that by Googling any phone number on the letter.

Drivers can be penalised for breaking the speed limit by any amount now, but the buffer is used by police at their discretion.

The 10% plus is discretionary.

Is the form a Notice of Intended Prosecution? It should require you to fill in the name of the driver.

Who is the form from?
Don't go down Fiona's route.
Have a look at the road on Google street view and see if you can find the speed limit signs. If it's reasonably local drive the road to check that the limit signs aren't obscured by bushes etc and take photos, if possible; this proved a good defence to someone as reported the other day.
10 percent plus 2 MPH is the legal leeway.
That is to allow for speedo error.

This happened to me Caran, last summer.

The first form is to identify you as the driver of the car on that day at that time, in that place. Unless you werent there, genuinely, then you have to sign it and send it back.

Then in due course you will be sent another letter which should offer you a driving awareness course for £100 approx or a fine £100 approx and 3 points on the Licence.

In this climate I'm not sure theyll be running the courses, but if they are do it. Its a half day and easy. I couldnt for one reason or anotehr but OH has done it before.

This is how her fall from grace started.
The "10% plus 2 mph" is a guide, not the law.

The then Association of Chief Police Officers (ACPO) issued guidance issued in 2013 saying enforcement would normally occur when a driver exceeds the speed limit by 10% over the speed limit plus 2 mph.

There also appears to be confusion over the plus 2 mph and plus 1 mph guidance.

As the guidance is 10% + 2 mph before a fine is considered, 10% + 1 mph is the limit to AVOID a fine.

As said already, this is guidance and a fine can be considered even if only 1 mph over the limit.
