my moms ex husband had his stimulus deposited into her bank account not by mistake he just was to lazy to take the appropriate steps to change where the money was deposited anyway my mom does not want to withdraw the money and hand it to him for many reasons like he has reported it to the irs oh i should mention they are recently divorced and my mom was the sole bread winner of the household meaning the bum never had a job except jobs that paid under the table like scrapping so he never paid taxes which is why his stimulus was set up to be deposited into my moms account. he now owes my mother back child support up to 5 months any way if he goes to the police is there any way they can press criminal charges against her she still has every bit of the money in her account

This sounds like a US-based query. This is predominantly a UK site, so you probably won't get an answer. But anyway, good luck with sorting the *** out.
You've posted on a UK-based site, where, to the best of my knowledge, we don't have any regular contributors from the USA. (Certainly not in 'Law', anyway) Our laws here are very different to those in the USA, so it's unlikely that anyone on this site will be in a position to help you. (Sorry!)

Hahaha - The bum has paid into ex wife’s account. The money is gifted to her & not theft. Hope she has a good spend up but if she’s worried I can give my a/c number for laundering ;)
I would suggest that if he wants the money back, your mom will have to pay it back.

If he can prove the money is legally his, she has no right to it under law, morally yes, legally no, and it's the law that counts.
He is money laundering without her consent, thus incriminating her. The money is a gift & NOT theft!

generally no - OR only with agreement

so if he demands the moolah ( the bum!) she has to pay ( cough up). Child support - she knows wht to do: family court and get a garnishee order

and by the principle of equitable tracing, he can follow it and claw it back from your mum

That is money laundering & if mum returns money she is complicit in tax fraud, which is a serious criminal offence.

I suggest you are letting your emotions cloud the issue, and the reality of what has actually gone on here.

The money does not belong to the lady in question, even though it has been deposited in her account, and keeping it is against the law.

It may be possible for her to agree to repay the money to him at, say, $10 a month, thus showing intent to return his money to him - I have no idea, i am not an expert in law.

But I do know that laws are based on statutes and precidents, nt on your emotional angst against this individual that you have never met.
