A thin burger with a larger diameter might weigh the same as a thicker burger with a smaller diameter.

I would say that as long as the cooked weight is the same as or close enough to, the one in the photo, that would be okay.

Regarding the size in the image, the average size of the buns could be used to calculate the size of the burger or the size of the seeds could be used to guage it.

No doubt experts on both sides would be used and they could also look at any other images of the bun taken at the original photo shoot to see if they can give more of a clue.
assuming the buns are all the same size (maybe a rash assumption, but these franchises do rely on such standardisation)) it's obvious the publicity photo shows the meat bigger than the bun, while the real-life photos shows it smaller, which matches my own experience. It's more than just the camera angles.

As mentioned, BK lost a similar case in Britain.
If the burgers are different thicknesses and diameters but the same weight, there is no deception that I can see.
well, that's what the case is about: the claim is that there's only half as much meat in real burgers as in the ad. Many would be grateful, of course.

Not sure it's about the photogenic qualities of burgers, more to do with US lawyers trying to get compo for their "aggrieved" diner clients.
if I was only getting half what I paid for I'd be aggrieved too. The demons of hunger would be rising within me.
It reminds me of the scene from Falling Down

Court case should be a right bun fight.
It is a bit odd they can do this with food, but other products e.g a car, house, frying pan, whatever - if the thing you were given looked nothing like the advert the complaint would be upheld without question.
