That depends on the document being witnessed, For example, a witness to a will cannot be a beneficiary under the will. However, a witness to the signature on a commercial deed is only witnessing the signature and thus can be a relative of a party. If you a re concerned about proof of the signature, get a different witness. A commissioner for oaths should only charge �5
