Please could someone give me some advice.
My son has just separated from his girlfriend who is the mother of his 3 year old son. His name is not on the birth certificate because his girlfriend didn't want it on there as it may effect her benefits.

We are very concerned grandparents and are unhappy with some of the decisions she makes.
We do not want to interfere we just want to ensure that our son has some influence on his childs up bringing.

Is there anyway we can force her to put his name on the certificate.

Thanks

While I can understand that your son would like to see his name on the birth certificate, I think that his main objective would seem to be to acquire parental responsibility.

Your son will automatically acquire parental responsibility if he acts with the child's mother to have his name added to the birth certificate. This presents obvious difficulties. However, this is not the only way in which he can acquire parental responsibility. He can also seek a court order. He might need a solicitor to help with this but, in the first instance, he can seek advice from ParentLine Plus on 0808 800 2222.

This post is based upon information from these two pages of the General Register Office website:

His name being on there will not affect her benefits all she needs to say is that she doesnt want anything to do with the father and come up with a good reason. But if she is already getting benifits its unlikely she will get asked to produced birth certificate again anyway plus any changes would be on a new certificate. He needs to try and get his name on there as legally he as no parental rights at the moment, he would end up having to adopt the child and/or prove he was his.
