No car Insurance
My sister has had her driving licence since April 2005, I know if she tots up 6 points within the first 2 years, she'll be banned. She recently recieved 3 points for speeding, and last week was caught by the police and given a producer. She hasn't got any car insurance, so am I right in thinking she'll be sent to court and given the automatic 6 points. This will take her to 9 points and she'll be banned? But her 2 years is up in April, it may take longer than this to organise her court date, will it go on the date she was caught by police and the producer or the court date? Bit of a nightmare, any advice please??

If a new driver picks up 6 points in the first two years he or she is required to reapply for provisional licence and resit the test ( practical and theory ). However, ( don't quote me on this but check it out yourself ) If she gets a ban then she won't have to resit the test and gets licence back after ban period with no points although there will be endorsements. I guess she should be praying for a ban if I am correct and I have a funny feeling that I am. Please post again to say if what I am saying checks out to be the case.
it goes on the date of offence,she will get 6 pts.which will take her over the 6 pt rule which means losing her licence and having to re take both theory and practical tests again, they might even decide to ban her as well for six months,will means she cannot take any tests for six months,and when shes back on the road,she will find her premium will be enormous,so i expect she wont bother getting it again,lets hope she dosent kill anyone next time,but now the local police know her,they will be watching her.

Shes been a complete idiot and not having insurance is the major flaw not the fact that it is within a 2 yr period. She needs to lose her licence and have a jolly good time spent maturing. If she breaks the law this much in the first 2 yrs then its not a good sign.
The CPS normally process driivng convictions quickly so i would think in the next fortnight or so.
