I live in a ground floor converted flat with my wife and two kids. I have a shere of the freehold together with the owners of the first floor flat. In the last year we have had 6 water leaks from the first floor flat. We have had repairs done under the insurance but have had to move out on each occasion. Can the first floor residents be prosecuted privately under negligence or are there any laws that require them to maintain their property. Tas
I got legal advice on the very same thing and its very difficult. I also found I was black listed with some insurers when I tried to get renewal quotes as I had claimed so often! Basically you have to prove that they were negligent each time its a pain I had 6 leaks over 5 years and it was a nightmare - also the flat above me rented out - I had written proof of me telling him about leaks etc but they dont care - I also tried to get my insurer to claim back off his and they couldnt do it either although they had all correspondence from me going back several years and even his tenants told them they told him of leaks and did nothing- I now live in a house and love it. I had never claimed before I lived in that flat and never have since !

I guessed that's what I'm looking at....and I am looking forward to the day I can sell and move on. I suppose the light at the end of the tunnel is that when I sell it will hopefully be to the neighbours from hell. The most annoying, dirty, noisy rude family on the planet.....aaah that puts a smile on my face!
