shoes and refunds

purchased a pair of shoes on saturday. tried them on in the shop and they were fine. tried them on in the house on sunday and they pinch and hurt. shop has now told me they will issue a credit note only or throw them away. so now i have to go to find another suitable pair that do fit me prior to a wedding next week. do i have a leg to stand on by demanding a refund

No you don't unfortunately.

The shop only has to legally give a refund if the goods are faulty or not fit for the purpose they were intended.

You should be able to obtain a refund from the shop that you bought your shoes from, however, if they have indicated that they do not give refunds then they may well be within their rights. Although a lot of these 'not-so-high-street' shops get away with this it is actually illegal.

The law requires a refund to be given in three circumstances only:

Not as described
Not of satisfactory quality
Not fit for the purpose.

The shoes are as described, they are not faulty and they are fit for the purpose.

I think they are being generous in offering a credit note. The fact you bought shoes that are too small is not the fault of the retailer.

looks like they are going on ebay

however, a not will be going to the head office of the shop as their staff didnt have to be so rude

try stretching them with leather stretch spray ( if leather) and use those shoe stretcher things

sadly the shoes are made of flock so are not stretchable

It is not illegal and as Ethel says they do not even need to give you a credit note if they don't want to. Also I believe it is illegal to show a sign saying they do not give refunds just as a point of interest, so I am sure they would not have been showing one.
