My partner and my daughter are british im not. We are apart from each other because of this. Im the mom and my daughter is with me in my country. Is it possible that if we apply for leave to remain it will be granted.

Why do you deserve it? Because you had a child with a british man? What are you going to contribe to the UK? What country and you in at the moment and why cant thye come to you?

Yep, marriage would probably be the easiest way but perhaps you would be allowed permanant stay seeing as your daughter is British, I'm not sure though.

I'm pretty sure most people would think you should be allowed to stay with your partner in the country your daughter is from though, I would ignore the above answer if I were you.

I used to work in immigration and it basically boils down to your nationality and the truth of the whole situation. Your partner wouldn't come to live with you and your daughter where you are now? Why is that?

You need to apply for a visa at your British Embassy. If your partner can prove that he can support you without you needing to claim any benefits, you have not committed an immigration offence like overstaying a visa previously, and there are no crimial convictions, you stand a good chance. The visa would usually be for 2 years and then you can apply for further leave and eventually indefinite leave to remain.

Getting married would make NO difference at all!! You can apply for settlement here as a spouse or unmarried partner.

for your info i have been to the uk 9 times visiting from 2000 my last visit being Feb 2007. We have been friends for years. He is in a very good job an contributes to the revenue of England. y do u think he should leave that to come to Jamaica. I am a Senior Secretary to the Director where i work so dont u even think i dont have much to offer even more than persons who live there n DEPEND on benefits to survive. My grandfather helped build that country n presently lives there so does my two bros, my cousins, aunts, uncles, and loads of friends. u talk as if i go run to get a baby to come there. u really hurt my feelings. i just wanted to do things the proper way as i am an upright lady and would never float my immigration status that i presently have. i own my house here so im no commoner as u r indirectly saying ok. its just that my honey/daughter's dad want us to be together n since both of them r british he wants us there.

nic was only asking those questions to help clarify your situation. he wasn't implying / sugesting anything from how i read his post.
your best bet is to speak to immagration and see what they say.
from my view i would say you have a very good chance but that's just my opinion. i don't know the law or your history.

She can apply for leave as an unmarried partner, and amongst other things would have to provide proof that the relationship is genuine and subsisting.

She can also get married and then apply for leave to remain as a married partner, but would also have to provide proof of the relationship. As there are so many marriages of convenience these days the decision maker will almost disregard the marriage certificate and instead look at the other proof provided. So really the marriage will only affect which section she applies under.
