i wish to change the exhaust on my merc cl55 to a straight through one, will it still pass the emissions test, as there will be no cats fitted?

If thats the case then how come when I removed tha cat on a Vauxhall cavalier 4x4 turbo and replaced it with a length of exhaust pipe with an exhaust flange at each end it sailed through the emissions test giving a better reading than it did before huh ??
