Can my father give me his house or sell me his house as a deed of gift if the house has a outstanding mortgage on it as dad wants the house to go to me if anything happens to him We were going to re.mortgage the house in both our names but as dad is 72 it is hard to find a lender can anyone give us any advice please.On how we can secure the family home this all came to light when mum passed away and the house went to dad now he wants the house to pass to me

Can't he just leave it to you in his will or is that too easy?

i would contact a solicitor there is something about inheritance tax? if you should sell it could it go in joint names? also if he has to go in a home the officials might think he is dodging paying for his care definitely a solicitor is required

he cant just leave it to him or he will end up paying inheritence tax, although im not sure how you will go about any other way

Just get him to leave it in the will. Anything else is problematic. The only benefit is if you are hoping to avoid care home fees but that's an old trick that would be picked up. You can always help him pay the mortgage. What advantage is there in buying it/ taking it off him now?
