i have just made a planning aplication and have a difficult planning officer she phoned me at work to say she was outside my property which has electric gates !! and requested i let her in so she could look around i said i could not let her in as nobody was there to do so she then asked if i minded if she knock my neighbour and climb into my property i said no do not as she is old and you worry her and she rang off she went neighdoor and asked to climb the wall into my property this was refused so she then went down a county lane and openned up my farm gates went across field s and gained entry to my home i told that it was not on so she has refused my planning permission i spoke to her boss who said well i think she said sorry can she do this thanks

In our area, when a planning application is made, it quite clearly states that a planning officer may have to make a visit to the property to gain a better understanding of the area and details of the application, could you not have suggested a suitable time for both of you to be at your address. I think it would have been in your interests to have been a little more helpful...........

Weas - yes, the Planning Officer has acted properly. I doubt very much she refused your planning application because of any difficulties between you - it would land her in serious trouble.

I agree with you new judge - no punctuation at all!. If nothing else, it made an extremely hard read. Not overly critical at all either - if people post questions on here they can at least try to meet the people who may help by putting them so you can understand them.

I understood that Planning Officers merely recommended or otherwise the proposed plans and it was the planning committee that actually makes the decision on planning. You should be able to get a copy of the reasons for refusal off the planning dept's website, if they have not already sent them to you - that should give you some idea as to why. You do have the right to appeal.

My computer skills are not very good.. how unkind some of you are ! she was asked to make arangements for entry as i work in itu at the city hospital bet she would like me there when she needs me!! i could not let her gain entry as we have electric gates !! no one home to press the button, and we have cattle.

Barmaid is quite right here... it's not the Planning Officer's decision at all...S/he will collect responses from all *interested parties* (like the Highways Department, Public Health, Countryside, Environment, members of the public, councillors etc etc). All applications are considered by the local authority's planning committee and judged on their own merits.

Weas - you need to find out why the planning application was refused and then act on those reasons. If you don't allow the planning officer reasonable access then how can s/he view your proposals within the surrounding area ?

the planning officer was asked by the aritectect to make arangements for entry ,she said she would come last week ,somebody stayed everyday and she did not show , she refused to make an appointment ,as this not how she works i bent over backwards to accomodate her , i just did not go into detail i have never met her or spoken to her . thanks to those who tied to help , those of you that didnt like new judge !!!!!!!!!!!!!!!!!!! sounds like an empty vessel

Write to the Chairman of the council and also the Leader of the Councillors, send your letters private and confidential.
State that this planning officer refused to make an appointment and all the other difficulties you have had with her and that you are unable to find out why you was refused, and ask them to investigate.

Some planning decisions are done under 'delegated power' by the officers themselves, others go to committee.

You have the right to lodge an appeal against her decision but this to be done within a time limit.

I'm glad someone has got it right! Definitely, some planning applications are decided by officials without going to Committee.

As well as writing the letters Sandbach suggests, contact the local Councillor for your ward. Meet with him/her & explain the problems you have had. Try to enlist his/her help.
