If one is a union member and works on a part-time contract, can the council (as the employer) sack you for going on strike for breaching your employment contract with them? Thanks
Technically i believe the answer is yes, although it rarely happens. However I'm sure the employer cannot sack some strikers and not others. The fact that the contract is part time is not relevant- a breach is a breach.
I'd agree with factor on this. Both Union membership and part-time nature of the contract are irrelevant - a breach is a breach, but being dismissed for this is unusual, and it is definitely unlawful to single one employee out for dismissal if others are also involved in similar action.
