Maternity leave
4 Answers
Hi all, my sister in law has been on maternity leave for 6 months now and goes back to work shortly, where she works everyone has just been given a payrise and yearly bonus except my sister, combined this amounts to quite a bit. My question is should she be entitled to both of these too, surely this is totally unfair.

So if she was working for 35% of the "performance year", then she should get 35% of the bonus that would be payable to some one who had performed to her level for the whole year.
That is the theory for how an an equal opportunities focussed company shoud work it, but it will depend on the company.
Has she checked her company policies on maternity rights and bonus arrangements? It might be in there but not being kept to.
Depending on how brave she is and how adamant she is that whe deserves it and will fight for it, she could go and talk to HR about how they came to the decision and calmly use the theory above to demonstrate what she feels she has contributed and should be offered.

Have a look at the link here, http://www.mondaq.com/article.asp?articleid=68 838. Yir SiL will be entitled to a hgiher amount of SMP (as that is based upon her average earnings) as long as the pay increase was awarded before the end of her 52 weeks' Maternity Leave. The bonus part is more complicated and may be reduced pro-rata to her time at work and the period the bonus relates to among other things.
