INsurance Claim
My partner whilst driving my car to work last year stopped at a T junction to turn right (there's a central reservation to cross although it's single carriageway) but the front of the car was over the halt lines. It's a busy road and not wanting anyone hitting the front of the car (volvo) she decided to reverse back a couple of feet. Having checked her mirrors to ensure no one was behind she proceeded to move back, she came to a stop and waited for a gap in the traffic to procede to turn right. Next thing ther is a car along side her with the driver cursing through the window. We now have an insurance claim against us for �500 damage to the other vehicle even though there was not a scratch on ours and certainly no signs of a collision. The first we knew of the 'accident' was 6 months later when the insurance was up for renewal when it said a claim was pending. What rights have we (or her as driver) over this? There was no documentation exchange at the time because as I said she didn't even know she had hit anything and there certainly wasn't a car behind her when she had finished her reversing manouvre.

For more on marking an answer as the "Best Answer", please visit our FAQ.This sounds like a Insurance scam, I would get the other party to bring their so-called estimate for you to check it out then tell them that YOU will be contacting your Solicitor, You say it was 6 months later?? that should tell you everything Just tell them to IS-OFF Im sure if someone backed into me I would stop them there & then, Its a scam Martin.
I've told the insurance company that I believe it's a scam, seems that the repairs have been done to their car already. The incident dates back to Nov 07 and I again got a call from the Ins Co to ask if I want to go ahead with the claim. Told them to send me details of the other parties claim form so I can then go to my Solicitor, I'm not happy, as I said it was 6 months later when I found out about the claim and I have only had 2 conversations with my Insurers regarding the incident and one of them was today.
Hi Martin, Been there seen the video, but the other party never got the biscuit, Are you a member of a Union? If so can they help with a solicitor? If not to start as I have said 6months that would not stand up in court, why has he /she had an estimate without first contacting you? that puzzles me, Please do not take this the wrong way, Did your partner hit the car but was afraid to tell you? Its been known to happen, but going back to what I have advised, If they start sending you nasty letters contact a Solicitor & state this to the other party also inform your own insurance & explain the problem & let them deal with it that is why you pay the *******, this is going to be interesting but do not be intimidated, Good Luck. Thanks TWR I worked in the Court system for many years so can get any legal assistance i need for free so that's not a problem. I know she didn't hit anything and not tell me for 2 reasons, she is a very careful albeit slow driver - having been pulled on the motorway for going too slow and the other reason is there was absolutely no damage to my car. OK it was a Volvo but even so there sould have been scuff or paint marks from their car. Incidentally I traded the Volvo in in May this year in A class condition and the garage went around with a magnifying glass.
Hi again Martin, well I am glad for your sake at least you have some proof that the car was in mint condition, These scammers really get my back up & I will go all out to help people that have been taken advantage of, a lot of people will except claims or the like because they do not like the hazel, I could tell you quite a few story's but I do not want to boar people but each time I have come up on top, I do not want a halo, My reward is when I win for someone. I do not know about technical details and insurance but in my opinion he must not have been paying attention. He hit your car far down the side. If he had hit on the front wing you could say you both went for it 50/50, but to hit so far down the car,

Cassa, there were no details exchanged, as I said the first we knew was when the renewal quote came through several months later with a note saying there was a claim pending.
UPDATE
I have had notice from County Court that the other party's insurance company has started proceedings against ME regarding the costs to repair their vehicle NICE!
