Online Visa Waiver Form

My sister and partner are wanting to join us on a holiday to Florida later this year. Her partner has a criminal record for a crime commited in Ireland( served short sentence in Ireland, but will be getting british passport)so i know we should really apply to the embassy for a visa but we are going to risk ticking no on the online form. Doe's the us immigration have access to criminal records? If we do the online form for him and it comes back ok are we more likely to get thru immigration ok? and does any1 know of any1 whos lied and been ok?
