Have a good look at your biometric passport.

Is there anything printed on it to say you have a criminal record? No. Then there's nothing on the chip that says so either. Was there anything on your passport application form about a criminal record? No. There won't be on the passport then.

Common assault is not normally a crime involving moral turpitude so you shouldn't have any worries anyway.

Thanks for your answer so I would be within my rights to say no on visa waiver and not be breaking any rules
Do the ESTA first, they don't have access to general criminal records so If you get permission to travel then fine - but be aware that there is no such thing as a "spent" conviction" in US law, once a criminal - always a criminal!!!
