hya guys, wonderin for abit of advice, 'a friend of a friend' has been arrested back in feb for threateneing to kill his girlfriend and, at the time being in possesion of a knife. The police (and obviously everyone else) has just 2 and 2 together as to why he had a knife but this is a one off mistake and completey out of character. Difference being, i know the state he was in that night and was excessvely drunk and what seems to me a drunken argument with his girlfriend and he claims the knife was for his own protection he rang the police and had himself arrested, bit like a cry for help. He in despeate need of counsellin as everyone who knows him knows already, he is going to apprearing in crown court for sentencing in 2 weeks as pleaded guilt for the offence. he was given opportunity to see a probation officer for pre sentence reports? is this a good thing? and if anyone knows would or could this lead to custdodial sentence or just suspended. Please any advice wuld be great thankyou

For more on marking an answer as the "Best Answer", please visit our FAQ.pre-sentence reports are not an "opportunity". probation staff will take details of your friend's life/lifestyle, and will produce a report to the court recommending guidelines for sentencing. they will consider his suitablity for different types of sentencing.
I'm not sure if a defendant can refuse to comply with probation at this stage, but I suspect he won't be doing himself any favours.
