GBH Case Few Q's

Hi everyone I'm new here found this place while searching for some help, I've been acused of GBH section 20 I have a clean record, I'm pleading self defence its a clean cut case I'm acused IP sustained a broken Jaw there was one punch thrown by me and the IP confirms this in his statement I have a great witness h has his brother withnesing for him, barristers are telling me I could do jail if I loose the case and now I'm panicing as I thought I stood a good chance Thanks for reading Ross !

A few years ago I knew someone who got 9 months for this offence, he also broke another man's jaw. He got 9 months custody and was out in 5, he had got previous though.

Hi it was an argument in a bar I was driving had nothin to drink my friend along with me also had no alcohall as he was driving also got hasseled allot during the night (friend confirms this) man was ignorant and very pushy me and friend leave bar to go home man follows lungs towards me then I struck him once he fell I walked away, IP sustaine broken jaw 2days in hospital, I'm from N.ireland by the way if that matters, tomorrow I face a decision where I can plead guilty or not guilty my heart is saying not guilty as I had no intension harming this person and def did not have any intension in causing the harm that I did, but my head is saying guilty because I never so much been in court before and to face a trail and leave it in the hands of a jury and end up ion prision for doing what is only human nature to protec yourself is daunting , Ross

I appreciate that your saying you only punched the IP once but what are the circumstances of why you had to assault the IP and were there any alternatives.

I struck the IP as I felt threatened, I knew he was going to attack me his mannor sugested I was in harms way so I made sure he wasn't able to I struck him once and as hard as I could could but in my eyes there is no lesser I could do than run and that would of left me vunrable to being attacked whilt me back was to him ! Just wondering do I have any right to hear what sentence I will receive by pleading guilty at earlist opertuninty even tho it goes against all that I want to do I just don't want my fate left upto a jury !

No, I said he followed me outside and lunged towards me he was within a foot of me and was going to attack me, I thought it rather stupid that you have to wait being phyically attact before defending yourself ? Ross

Anyways I'm up tomorrow for my plea still not sure yet which way togo, barristers are being less than helpful but ill keep in touch how its goes for anyone else in a simalar posistion, I don't need to lie on here and the one thing I thnk has been misunderstood is the circumstances that led to the assult, I was being hasseled allot and he was being very violent and he made an attempt to attack me "lunged" towards is the term I use then I decided to act physically thanks for your replies talk soon ! Thanksyou for your help I was having doubts about my case and how it would do in a trail and your words confirmed this, I just need reassurance that a prision sentence wouldn't be givien if I plead guilty asap but there is no real way of knowing ! Ross

Ross, i understand you have made your plea already however, i hope you plead guilty! i plead self defence for ABH as i was attacked first, the judge did not believe my case, and was convinced i threw the first punch. she then sentenced me to 6 months in prison! GBH is more serious than ABH.
