How does an owner of a car get the logbook back off an unwilling registered keeper?
My friend is going through a break up and His Ex will not hand over the logbook (which is in her name) of a car they purchased 4 months ago, My friend is paying finance on this car yet she refuses to hand it over she has told him that she has taken his name off the insurance so even though he has a key to take it he can not get the insurance to drive without the logbook. In my opinion this should be classed as theft as he is the legal owner and she is now driving it and withholding the logbook without his permission Any advice would be greatly appreciated.

For more on marking an answer as the "Best Answer", please visit our FAQ.I told him to contact dla to say it had been stolen but then thought they would just send it back to the address they both lived and her name. would this not be the case then? we are aware that the finance company actually own it so do you think they will force her to give the logbook to them as they have the contact with only my friend so they know he is eventually going to be the legal owner otherwise there is no point him paying it.
they did purchase while a couple but split 3 months later so 3 payments I guess have been kind of paid by both but he is the only one on the finance and she is expecting him to pay for the remainder of the 5 years and her keep the car... obviously there is more to it and he has left her with the home and the goods in the home so I think he is not asking to much to want the car that he alone is committed to pay for. I believe he has to pay extremely high insurance as he is not the registered keeper and some companies will not insure at all. she is also telling him that although he has one of the keys she has been to a solicitors and they have advised her that as she has the logbook if he takes the car it will be theft and she will phone the police
