X husband on Birth certificate

My x husbands name is on my daughters bc, he is not her father and his name only went on cause her biological father is out of the picture and we were married, we have been divorced for over 2 years now and I want to take his name off her bc for numerious reasons, how can I do this??

Well, you have put something on her birth certificate which is not true and unfortunately now you have a big problem. Will you tell your daughter the truth when she is older as she surely has a right to know who her real father is, it is a fundamental part of who she is and a normal human urge to know. He might be out of the picture for many reasons but he is her father and I do not know all the ins and outs of it but you have stated that your ex is the father and you are pretty much stuck with it. A birth certificate is a record of birth for your daughter and her children and it would probably have been better to have left it blank than to put something that was not true. However I am sure you had your reasons.
If a mistake has been made on the original birth certificate, the parent(s) can apply to have it corrected by contacting the Registrar General. The Registrar General will need evidence that a mistake has been made, and proof of the corrected information.

It is an offence to give false information when registering a birth. However, the Registrar General would not necessarily take action against someone who made a genuine mistake when registering a birth.

Lady_p_gold is not strictly correct. Although technically you did lie about the child's parentage, the law assumes that any child born during a marriage is the child of the husband. If you were married when your daughter was born you have not lied or broken the law.


If Ursula62 is correct, then I am pretty sure it will be impossible for you to remove your ex from the birth certificate.


If you decide to remarry, your new partner may be able to adopt your child..in which case a new birth certificate will be issued. I have a new birth certificate as I was adopted by my stepfather. My old certificate is available for me at the records centre. If your child wishes to see her original one than she will be able to.


Why would you want to take his name off her certificate? I would think that having a name at all is better than none..but you must have your reasons :o)

Kempie is correct. You must make contact with the 'general registar office. though they will make contact with your ex-husband to confirm that he is not the father. Something similar happened my husband recently. His ex-wife used his name on her sons birth Cert when registaring him.(She was still married to him at the time). with both parties consenting his name was taken off the childs B.C.
