soldiers are exempt from Murder as part of the definition states (murder is committed) "Under the Queen's Peace".
Further, although Euro Convention of Human Rights has abolished the Death Penalty, under War the Govt have the right to lift any sanctions. Therefore the Right to Life (Article One) may not be as straightforward as it appears.
Further, the Police etc have the same powers as civvies when they take lives it's just they have a license to have weapons etc.
Only a few defences to Murder under common law and they are,
Provocation i.e crimes of passion
Diminished responsibility i.e madness
Suicide Pact i.e you kill people (and yourself) in agreement that they all want to die.
That's it. Self defence etc are not excuses/defences as it wouldn't be a murder in the first place.
