Can someone help me with a problem my family has?
About 18 months ago, my brother in law BIL (soon to be ex) wanted to buy a moped but as he had a poor credit rating my mum took the finance out for him and he agreed to set up a standing order to her for the monthly payment amount. My BIL and his wife (my sister) soon fell into financial problems and he has never paid a penny towards the finance on the bike.
My BIL and sister have now seperated and he refuses to pay my mum anything as 'he doesn't like her' so my mum has been forced to borrow the money from a friend to pay off the whole thing and is making repayments to her friend.
Is there anything she can do seeing as the bike finance was taken out by her (although his name is on the registration document). Would she be able to take him to small claims court? I wish we had Judge Judy in this country!
The bike is now being held at a garage for non-payment of a repair bill!

For more on marking an answer as the "Best Answer", please visit our FAQ.i would suggest you pay the repair bill and get the bike out of the garage - then sell it - i'd imagine the bill will be a lot less than the bike is worth.
take your sister so they will see the names are the same and take a copy of the finance agrement so they can see you are the owner of the bike as you are paying for it.
