Stopping Csa payments

My husband has alway's paid Csa to his ex, he paid till after his daughter was 19 and in full time education, (he still helps her out now, but does that directly to her) His son is now 18 and was on a BTEC course, so my husband still pay,s the money directly to his mother. But we have just found out, that his son has not attended college for several month's and has packed the course in. He is reportedly looking for a job.
So do we still have to continue paying money to his mother.?
My husband has no intention of not supporting his son, but would prefer to do it directly to him and not to his mother, Can anyone clarify the situation.

If Child Benefit is still being claimed for the lad your husband will have to pay maintenance to his mother. It is probable that it will still be paid under the circumstances you have described. At 18 the boy can make a claim for income based JSA. If he is claiming JSA Child Benefit should not be claimed and the Child Benefit Centre should be notified as any claim is fraudulent. As soon as he reaches 19 Child Benefit is no longer paid and the CSA will close the claim. Unless there are arrears of child maintenance the CSA will no longer be involved.
Thanks for the quick replys, We have not got a clue if he is claiming JSA, or if she is still recieving child benefit ( i would guess she is ) Is there any way that anyone know's off, that we could find out.?? As we are not told anything, Again I state we are more than willing to pay and help his children. But for over ten year's this woman has bled us dry. We have even lost our house and are now living in rented accomodation, (even though we both work, while she does not ) She lives in a four bedroom house with a new partner, which they have bought, And brags to everyone about how we are paying her mortgage. As you can guess !!!! we have totally had it with her, and just wish to finally be able to cut all contact and deal with the children directly.
It's simple. Get your husband to call the CSA tomorrow, he should have the number on some of his letters and it's easy to find on line. Tell them he believes his son has left full time, non-advanced education, that's 'A' level in England and Wales and Highers in Scotland. Most BTEC courses are considered to be non advanced. HNC, HND and university are advanced education and Child Benefit should not be claimed. The CSA is not interested in these cases.
If your husband is like mine and would rather you spoke for him in situations like this the person you speak to should allow him to give verbal authorisation for you to explain the problem, it is up to the officer if they accept it but most of us do, this will only be allowed once and written authorisation will be needed in the future. He will have to go through a security check when he phones but it's stuff he will know.

The agency will request a Child Benefit read out (takes minutes) and it will say if it is, or is not, still in payment. If it is in payment the end date will be his 19th birthday. If it is not in payment the case will be closed with an effective date close to the date the Child Benefit claim ended. You should suggest that he may be claiming JSA as he is no longer attending college and you would like it investigated. This is easily checked. I know everyone thinks we're out to get the NRP, but we are also keen to stop benefit fraud by the PWC. I have worked at the CSA from the start and have found that Non Resident Parents like your husband listen to all the horror stories in the press and never contact us if they have problems because they believe we're always on the Parent With Care's side. This is not true. In an ideal word the CSA should not have to exist, parents should be happy to make a private agreement. But our job is to work out a fair agreement for the benefit of the children.
