Boyfriend On Remand

Hi my boyfriend went to a man's house for a drink there was 2 other men who are drug and alcohol users past convictions and charges my boyfriend only had a drink no drugs he has no previous convictions only 1 charge which was battery. So what I heard there was an argument not sure who started it he got hit round the head with a weapon from behind and knocked unconscious causing 2 lacerations above his eye 2 black eyes and his nosed pushed to the sidehe does not know who did it then as he was waking up somebody was on top of him so in self defence my boyfreind lashed out but that man was sent to hospital with facial injuries and had to have facial surgery. But my boyfriend was arrested there and then while he was still dazed and dizzy from the attack. He was sent in remand two days later and charged him with section 18 but the victim and the other man have robbed and attacked people before and they are known to the police my boyfriend got refused bail at magistrates then again on his plea hearing which is so unfair he should not be on remand as he was attacked with a weapon is it possible he could get judge in chambers before his trial date which his trial is the 1st December 2016 also the witness who was there has dropped his statement

I have never heard of needing permission to change solicitors. Best idea is ther phone one of the ones on the list and ask, they are all specialists in helping people in prison. It would be a problem if the trial had started as the new solicitor would not have all the information, but I can't see how it is a problem before the trial starts.

It is NOT normal to react violently without thinking about the possible results of your actions. If that is what your BF does then he has a problem with anger management. This can also be the reason he is being denied bail, the police and cps think he would react violently if he was provoked and are not prepared to risk having him free.
A man whose first reaction to provocation is to hit someone is always going to get into trouble, the next person he attacks could be you!

1991, your bf will need permission if the legal aid has been granted to his present solicitor.

as all this on this thread is all hearsay .... did anyone on here see the event including 1991 ?

he has a solicitor and a barrister and the hearings have started ( bail refused etc ) and they have the details of the case from the accused, so what are we arguing / discussing ?

why was bail refused ? the short answer is the judge thought he might do it again. he will have given reasons in the hearing none of us attended.

and yes one of my co workers successfully pleaded self defence having been remanded in custody in Walton Jail for 60 d. on a charge of GBH.

If somebody is on top of you it's a natural reaction to lash out but he did not intend to cause any harm he was hit with a weapon first it's wrong people who are attacked but in there power fight back and they get sent to prison. And also a little story last year I had 3 charges arrested twice from June and august, first arrest in June was abh (which he admitted later he lied) and gbh section 20 i threw a plate at his face in self defence as he went to attack me with a another plate. His statement said I followed him and held the plate to his head saying i m going to hit you. So I was arrested 2 days later and released on police bail. On the 4th august I was arrested again foe gbh section 18 as I was accused of stabbing the same person in his lung he had to be treated as he nearly died struggled to breathe I was refused bail then they transported me to prison on remand I was only in there for 4 weeks my solicitor applied for judge in chambers and they released me on tag then after 4 weeks they changed tag to doorstep curfew the first 2 offences were thrown out so i was left with that serious offence gbh section 18 this carried on for 9 months till may this year then they acquitted it judge found me not guilty as cps said there was not enough evidence and no proof I was there so yes fair enough my boyfreind admitted kicking out but in self defence after being hit by a bar round his head and knocked out he's going to wake up scared and shocked he thought the men on top of him was going to do it again so his natural reaction just like I did last year he kicked out just like I did with the plate. Also he was denied bail because he was already on bail before he went on remand but now that case has been thrown out o don't understand why they refused him bail he is not dangerous by the way he's laid back trouble always seems to come to him

It was not the judge who thought he would do it again it was cps who said it the judge said it was OK for him to be bailed at his mom's address but cps repeatedly refused and my bf barrister didn't argue that he has nobody to defend him he feels let down

I have no history of violence what are you talking about? I was found not guilty I didn't do anything wrong. I'm sorry but what has that got to do with my bf being found guilty and going to be in prison for a long time? Sorry but you don't know what you are talking about he will be acquitted his barrister told him to plead not guilty so obviously he's got a good case to win it

Yes, people can read English they can read your history of multiple charges of ABH & GBH that you posted at 11.25. Just because there was insufficient evidence to convict does not that there was no assault.
Possibly your 'luck' will continue and your BF will be found not guilty, stranger things have happened!

Read again he lied that I broke his wrist he accused me of it then later told the police he lied!! And threw the plate at him in self defence!! So are you obsesed with people being sent to prison? I'm sure you work for the cps

Yes same bf the one who's on remand now we had our ups an downs but still he's my baby's dad this is not the point the barrister told him to plead not guilty for a reason cps have not got enough evidence to prove my boyfreind stayed the attack first as he police told my bf at the police station the victims and wonteses statements don't match up so it's them who were lying not my bf he admitted kicking out as he was attacked with a weapon!! And the weapons they have will have the victims or the witnesses fingerprints on them so one word against another

Forget the abh gbh sec 20 and section 18 this isn't about me this is about him he's innocent he reacted reasonably he only caught the victims face once with his foot which the cup the victim was holding went into his mouth causing a Chelsea grin lookalike and knocked out a few teeth my bf did not know s it was the victims fault for hovering over someone who he or te other person attacked it will be thrown out as many people have said
