Can My Ex Take My Car?

Almost 2 years ago my partner lost his mother. We inherited a car and instead of selling it, we decided to sell my older car ( a car I purchased before we became a couple) and take on the inherited vehicle. For context.. he does not drive, we have two children and I’ve finally made the decision to leave him due to domestic violence. The car is in my name and I am the only driver of the car.

He is demanding that I can not take the car and that if I do, it is left. He is trying to make me sign the log book over to him. Does he have legal grounds to take the car?

It also cannot be ignored that you did something in reliance of having use of this car.
You sold the car you owned outright and I assume the money went in to the family pot.
If that's true, then you may have a case to be put back in the position you were - for example, he give you what your old car would be worth if you sold it today (you've had the enjoyment of his mother's car in the meantime).

Personally, I think he is being an ass. He can't drive the car and I assume the children will be living with you most of the time - your need is greater than his.
I assume you were not married...in which case AFAIK...

The old car was yours, you sold it and presumably pocketed the money, although its irrelevant whether you pocketed it or not...so long as you received the money for it and did with it what you want.

Regarding the new car: It was left to him in a will, so its his; he may of agreed to keep it and allow you to use it, for the families benefit... but its still his. So unless there is any documentation to contrary, (eg a signed agreement that he has gifted the vehicle to you) then you will have to give it back to him or buy it off him....perhaps with the money you received from the old car?

If you were married - you own everything!
