There is a plum/ damson tree in a private garden near my house. It is just the other side of their fence. However, the tree overhangs a public footpath with lots of juicy looking fruit which are crying out to be picked. Can i pick the fruit which overhang or can they report me for scrumping?

Ok. Maybe I'll just ask. If I promise them a bottle of the plum wine that I plan to make, they can't refuse surely!

I used to love scrumping in my youth, don't think about it then, but in reality, its stealing, i'd do as suggested and ask, i'm sure they'd say yes, otherwise the overhanging fruit will go to waste, another point, once dropped, they could could pose a danger to passerbys, bit like stepping on a banana skin.

well you are allowed to cut branches which overhang onto your property ... but I suppose this is a public footpath ...
Well i would ask , due to this day and age with all the wallys about, it wouldnt look good for doing 30 days in a prison as a plumb thief lol.
A piece of friendly advice. If you do ask the owner be careful about the terminology you use i.e. do not say "I'd love to get my hands on your plums!!" especially if the owner is male and bigger than you.
