buying us out
Hi - we have a property to sell that was left to the family in a will. The rest of the family (three other siblings) are wanting to wait until the market picks up but we could do with selling now. Do we have to go with the majority or can we ask to be bought out?

They have a duty to sell, but normally will be allowed to postpone sale. You can ask the other beneficiaries to buy you out. They do not have to agree though. If they don't your only option is to apply for the Court for an order for sale. Your action will be against the executors (unless the property has already been transferred to the beneficiaries)
