I was recently asked not to smoke OUTSIDE of a restaurant. Were they in the right to insist on this?

Hey, i would ride a bike if i thought it was safe, and if i could have a shower when i get to work and get back in time for the simpsons and it could carry my shopping and if a puncture was easy to sort out.

Is there such thing as an eco friendly bus?
All this eco rubbish is a big con to get more money out of people.
They charge you more for an "economy variant" when in reality, all it is is exactly the same or slightly tamed down.
I cant believe people fall for all this ozone layer rubbish.
Its about time they invested in space exploration, then you could smoke where you want, even where people are eating...

I have to say, the owners of the restaurant were correct if they owned the land. I also agree with people being banned from smoking in enclosed public places.
However, what drives me MAD is the woman next door to my office. A small group of us - no more than 3 or 4 will congregate at the back of the premises at lunchtime for a coffee and a fag - not every day - probably 1 in 8, to be honest we are rarely together at work. This is private property. 4 floors up next door sits a lady who has now made regular complaints about the cigarette smoke that wafts up into her office and "affects her asthma to such a degree she has to be hospitalised". Sod off. I walked past the front of the building earlier (and her room looks out on the front also - windows wide open and she is on a major bus route - approximately 6 buses an hour) and the windows were wide open.
I accept that people should be able not to live in a smoked out zone. I DO NOT accept that a couple of people smoking on a rare occasion outside on private property shoudl damage someone else's health. We have now been told to stop smoking outside. Quite!! That's why my attitude was sod off and sue!!! I wouldn't mind so much if we were directly under her window and it was only a floor up - but our ground floor juts out about 15 ft, so we are a minimum of 15ft from the buildiing she sits in - at least 20 feet to the left from her building and several floors lower. Silly cow.
if it's their property of cause they can insist you don't smoke... but they may not have been being as heavy handed as you think.
remember the legal requirement for a smoking shelter is it must have no more than 3 sides including the roof (basically speaking)
So if you were standing in a recessed doorway area or similar you would not have been in an area that meets the legal requirements for a smoking area as it would only have one open side

Barmaid - I have asthma and a severe reaction to cigarette smoke, to such a degree that I hadn't been to a pub for years before the ban and I have to keep my windows closed when my next door neighbours are outside smoking.
It causes my tonsils to swell alarmingly, and my bronchi become extremely inflamed which my inhalers don't relieve.
I have been hospitalised twice directly from other peoples cigarette smoke. Yes, that is my problem and not yours, but maybe it is that woman's too.

Ethel the lady bramaid is on about is 4 floors up. i find it hard to believe 2 smokers outside can cause her harm.
On bonfire night and for several nights after i would expect her to be on her death bed
