The entire sentencing system seems to be a shambles.
Who is to blame? Or is it a joint effort?

Man in local paper had loads of points and still kept his licence because he did not turn up in court so the court found him guilty in his absence and gave him points and fine but because he did not appear in court they did not ban him.

There are a number of issues here.

Firstly, as has been stated, magistrates do have the discretion not to impose a ban if exceptional hardship will ensue. Unfortunately in some areas this discretion is being applied too liberally by Their Worships. The “loss of a job” as suggested by the DVLA spokesperson, is not exceptional. Anybody who needs to drive for his job should realise that his employment is in jeopardy if he is banned. There is nothing exceptional about it.

However, a number of drivers have multiple aliases, do not appear in court for a hearing and their driving record is not readily available to the court.

The system needs tightening up and a start would be to remove Magistrates’ discretion by making th eban mandatory (as with excess alcohol).
