Possibly because they already lived there before the benefit cap was put in place.

i know a million isn't a fantastic amount for a home in London, but it does seem that some are getting away with murder.
The cap wasn't retrospective I should have said.
If it's a rental property in a large City like London, even small houses can have a huge market value but the rent will often be within the LHA.
Question Author
but are they not asked to move to somewhere cheaper?
I agree Em.

what is the LHA,
If they do not work at all then I think they should be moved somewhere cheaper. I'm sure many people working would love to live in Central London but can't afford it.
Using that resource and popping in a few postcodes will give you an idea of the huge differences.

One bedded property , my area - Lancs - £85 per week.

As above - Brighton - £153 per week.

thanks. i still don't get it, the h/b must be a small fortune, not to mention this guys disability payments. not sure if i could find a link to that particular case.
Disability and other payments are not altered by geographical location, but Housing Benefit is.
Just because a house is worth £1 million doesn't mean it was bought for that.
And aren't many of these £1 million houses owned by the council?

If someone is in receipt of HB then they obviously don't own the property so the value of the house is irrelevant - they will receive the LHA as set by that Council.
Question Author
this was the case in question, however there are plenty of others

Question Author
captain thanks.
A Housing Association owns his home, so if they moved him out they'd simply move someone new in.

Please not - I am not fighting any corner for any particular claimant just trying to clarify how it works.
Question Author
mamy thank you, i am not sure i am any clearer, but at least this chap, if its proven he is fit, will be booted out the country.
