Why was he in custody for 10 hours? The usual procedure is that if you fail a roadside test you are arrested and taken to the station for two more tests, the lower reading being the one taken into account. Depending on the result you are either released without charge or charged and released on police bail. This should not take 10 hours.

Yes which is why it’s illegal and as mentioned earlier you could buy a breathalyser which are cheap and easily bought or better still refrain from driving as we all know that hungover= being phyyand mentally impaired which =you’re not fit to drive one ton of metal at any speeds as your vehicle is now a potential killing machine.

(1) Subject to subsections (2) and (3) below, a person required to provide a specimen of breath, blood or urine may afterwards be detained at a police station …if a constable has reasonable grounds for believing that, were that person then driving or attempting to drive a mechanically propelled vehicle on a road, he would commit an offence under section 4 of this Act.
