False Claims

I don't often venture in to 'News' but this is a disturbing case https://www.dailymail.co.uk/news/article-11595853/How-womans-false-rape-trafficking-claims-Asian-grooming-gang-sparked-national-outrage.html

What motivated her to bash her face with a hammer that she bought and make up all these lies on social media? Is she an attention seeker, hooked on getting 'likes' or is there something more to it? Could she have been groomed by a 'far right' mob or does that only happen in Corrie?

I know she's not the first to make false claims of rape and she certainly won't be the last, but this is probably the most extreme instance. Did she report it to the police herself or did they get involved because of her social media posts?

I have no idea what the appropriate sentence would be.

Whatever she gets, I hope she gets some psychiatric help alongside it, and support in realising what a disservice she has done to every woman who has genuinely suffered.
Question Author
Yes, indeed, Rowan, she must have psychiatric problems of some sort.
I hope also there are some apologies to the people whose lives she has ruined, including the man she said raper her who was with police at the time. Unfortunately, some people think that mud sticks and these peoples' lives will never be the same.
Question Author
People have lost businesses, their families because of this. Whole community up in arms, apparently.
I hope she gets a long enough sentence to enable her to reflect on the damage she has caused to those she has accused - and whose lives she has ruined - and the town of Barrow as a whole.
Whatever mental problems she may have are absolutely no excuse for such wickedness.
MAABOF!
In the Times as well
er DOI - I was accused by an ex tenant
in the good old days of "You will be believed"
now watered down to "You will be taken seriously"

and so long story short - the police came around and invited me to refute the story ( that they wd otherwise believe)

Not that easy - achieved, triumphantly on one part ( me) reluctantly on the other ( poh-lyce)

and of course the police did not give a tass whether it was true or not or malicious. I was keen on the latter but cdnt prove it beyond reasonable doubt
There is this thing called witness immunity
( if a witness gets it wrong -oops! - you cant sue)(*)

BUT if there is malice ( no "and so my lord it must be....." you have to prove it. This means she has to say "I only did it to get him into trouble". Difficult v diffcult) - then you can

otherwise it is perjury as a charge or the lesser one of intention to pervert the course of justice (+)
Now in this case
someone was remanded
and so I think they felt ghey had to prosecute.

if they have to unwind a case like the wrong person has gone to prison, they will prosecute and the tariff starts off at 2 years
(*) a case cant beget a case ( Judge judy) except in.... the case of expert witness testimony at the GMC. Meadows got it wrong, ( defence: so what?) and got struck off.

(+) one old bagga - sozza Law Lord said - justice is never perverted , there can only be an attempt to do so. We use to shout Hurrah hurrah at his stupidity but now we just suggest retirement on an extremely large pension
she MAABOF no criminal liability den

sozza readers - as TTT says ' she is as mad as a box of frogs'. Now in that case you might argue that she was not criminally liable by reason of insanity

actually I dont think she is mad.

The lesson is ( do I need this lesson) is dont lie to the police or the court
I believe her completely, yessir!
is it more likely she was hit by a bad man
or took a hammer to herself?

Bad man hit I think
I hope they make an example of her.
//I hope they make an example of her.//

They ARE; don't ever say anything against the Pakistani rapists, - that's a hate crime!
Throw the book at her, but they wont as she is a woman.

This just takes the heat off the real grooming gangs that are about, doesn't she realise that?
Ken - // Whatever mental problems she may have are absolutely no excuse for such wickedness. //

Mental problems are never an excuse for such behaviour, but they can be an explanation, which is not the same thing at all.

It would appear that this woman has serious psychiatric problems that need to be treated, and the fallout from her actions generated by those problems has seen innocent people imprisoned, and all manner of dreadful damage to an entire community.

It's a dreadful situation.
Lady CG - // I hope they make an example of her. //

I think we should wait for appropriate psychiatric examinations to be completed before we assume that this behaviour was borne out of simply criminality.
YMB - // Throw the book at her, but they wont as she is a woman. //

If you mean that the punishment, if decided, would be more lenient because of her gender, I doubt that would be the case.

// This just takes the heat off the real grooming gangs that are about, doesn't she realise that? //

Highly unlikely that she does, or has any real grasp of the consequences of her behaviour - because people rarely do consider implications before they commit crimes, if they did, they wouldn't do it.
I have no idea what the appropriate sentence would be.

Well, bearing in mind that people who try to avoid speeing fines and points usually end up in prison for six months to a year, I imagine her sentence will be considerably greater:

https://www.independent.co.uk/news/uk/crime/chris-huhne-and-vicky-pryce-both-jailed-for-eight-months-for-perverting-course-of-justice-in-speeding-points-scam-as-couple-are-reunited-for-the-final-act-of-their-tragic-family-drama-8529546.html

I would suggest the offence lies at the very top end of seriousness. The underlying offence was a very serious one and there were serious consequences for innocent parties. If a judge sees it that way, the guidelines (which are currently only consultative) have a starting point of four years custody. I would not be surprised, in view of the wider damage caused in the community, to see a sentence in excess of that.
Question Author
Thanks, NJ. Do you think she could be the victim of some far right extremists that forced or encouraged her to do this? I know it is pure speculation on my part.
