No, interestingly enough it is one of the exemptions, don't really see why though, I mean people are employed in prisons aren't they? I suppose it would interfere with dope smoking holiday camp atmosphere somewhat!

Care Homes, Prisons and the like are considered as their place of residence.Different from smoking in a public place or indeed workplace.In saying that they will probably ban smoking when guests of HM are sewing mail bags.

Yes it applies to Betting shops indeed anywhere (not withstanding prisons etc) where someone is employed.

MPs voted on Tuesday by a margin of 200 votes to impose a ban on smoking in all enclosed public spaces, despite months of wrangling over the issue e.g. it doesn't matter if someone works there or not - thus some bus shelters will be non-smoking etc http://news.bbc.co.uk/1/hi/uk_politics/4714992.stm

though as you can see from the linked article prisons are execpt for the reasons already discussed

There would be all sorts of riots if smoking in prisons were banned, very good question though. On paper it should be banned. Glad her magesty's guests are keeping a liberty that I'm not. Another needle in the wound, already wound up by the Houses of Parliment bar!!! (thanks for pointing that out laurence2 ;o)

smoking is allready banned in police stations the staff and police use a shed outside to smoke in..the prisoners in the cells are still allowed to smoke!! apparently its to keep them calm as if they dont get a smoke they kick off big time...they shouldnt be allowed a smoke in prison its supposed to be a place of punishment without rules being made especially for them selves..

It all makes sense really, smoking is now banned in pubs - but not in The Houses of Parliament bar, or Prisons! Speaks for itself really!

It's another "Do as I say, not as I do" situation!

Heres one for you, as you are aware you can't smoke on trains Unless you,re staff, ie driver/guard etc.

Now train companies advertise NO-SMOKING on our trains, so what is the law now or should train drivers etc be allowed to smoke ?

So let me get this right - it seems to me that most people like the fact that the smoking ban has been voted in for two main reasons:

1. It effects other peoples health by way of second hand smoke


2. It stinks

And now people are annoyed because prisoners will possibly get cancer and smell bad?

I think some prisoners should be fed on dried bread & polluted water, but I don't suppose that will ever happen!

Yep Gef - it was on the news & in the paper this morning - The Daily Mail I might add!

I've just popped downstairs to look at the paper & it actually reads:

Stubbed Out - MP's vote for smoking ban in pubs & clubs from 2007 (but not in the Commons bar).

Almost the only places where the law will not apply, will be the bars serving MP's & Peers, it emerged last night. The Palace of Westminster is classed as a Royal palace, and therefore exempt!

So although it doesn't actually read 'The Houses of Parliament Bar' as was mentioned earlier by fellow AB'ers & myself - it all boils down to the same thing - one rule for one & one for another!

well according to the Bill available here , if you would like to look under exemptions then there is nothing about the Commons Bar - just about places where a person has a home / temporary home.

If the MPs voted to allow members private clubs to remain smoking areas, then the commons bar may have also been exempt (it being private not public) but since they voted for a total ban that (to me) would imply that the commons bar is also affected.

That said, I am sure that the Daily Mail would never print something that was so blatantly untrue ;-)

I'm pretty sure it is true, Buckingham Palace is exempt. To me, I don't see how the commons can have a fair vote on something that is not going to affect them?

Of course Buckingham Palace is exempt - it is a residence. Everybody's home (including second home, caravan, chalet, motorhome, canal boat & tent) is exempt.

The House of Commons is not a residence as far as I am aware (though it could be argued that a lot of people fall asleep there).
