i accidentally bought an iphone online . while i was willing to accept that the phone is faulty while it says stuck on apple logo it also states fully functional. if i open dispute what is the chance

How could you accidentally buy an iphone? Where did you buy it from?
If it was bought from an online trader you have the automatic right to a full refund on any goods that you decide to reject (with a few exceptions, which aren't relevant here), irrespective of your reason (or complete lack of one) for returning the goods. So it makes no difference whatsoever as to how the phone was described or what condition it arrived in. [Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013].

If the phone was purchased from a private individual then it must be 'as described'. [Consumer Rights Act 2015]. Without seeing the item description that you responded to (which, from your post, did indicate that a fault existed), it's hard to know whether the phone you received was 'as described'.

If the person selling the phone was clearly (from their sales history on eBay or elsewhere) buying goods and then reselling them, rather than just selling their own things that they no longer need, the seller is legally a 'trader' (even if they're not registered on eBay, or similar, as a business seller) and my first paragraph above will apply. Otherwise you'll have to rely on the second one only.

well the seller has some negative of not sending item.. ha i was half asleep when i bought. the seller made it out to be something tiny wrong when it is something major

yep i tried that and itunes when it was connecting was error 9
If they did say there a fault it is almost as described. The reset might work but if seller has negatives you maybe unlikely to get any joy. If that's the case use ebays dispute procedure. I no its 20/20 hindsight but I always avoid sellers with negative rating!

i pointed out everything to the seller about the misinformation and got a request to send back
Ok that's a result don't know what you paid but may be worth sending it registered to prove postage

im posting from ireland. one thing asked was to open a returns case rather than what i was going to do
If you are in Eire then think you postal supplier is Anst? If you go to their website you can find costs cannot post the costs page for some reason? Do not understand what a returns case is .

well i understand what one is but i can't find it even with ebay help
All details are on Ansts website. Unless vendor is going to supply one, but normally it is buyers responsibility to pay returns costs with eBay.

well it about 10 euro with an post but that be included in refund on return it all about getting to the page on return
