Joint Fence

I have a joint fence with my neighbour which needs at least repair, if not replacement. My neighbour wants to add to the original height of 5 feet and make it 7 feet but I am not agreeable as it is fairly close to my property (and windows) but not to his. The deeds state that the fence is to be maintained by mutual consent and the Local Planning Department Regulations state that he may increase the height up to 2 metres regardless of distance from my property, but above that he has to seek planning permission.
I agree to the fence being repaired/replaced but not to the increased height. Has anyone else resolved this problem satisfactorily? Thanks for any help.

you do realise that he could quite easily errect a 7ft fence just inside his boundary without needing to ask you and youd have the same problem.

can you compromise at 6ft or perhaps 5ft with a trellis above to 7ft?

U dont have to help with costs.....so let him pay (since he's determined to have his way). Better for u to be positive and accept the inevitable.

Once the fence is up, the fun will be how to compromise it.

They need planning permission to go above 6'6, so compromise at 6'

I don't know about you, but I would take a-fence at my neighbour's attitude over this!
