I live in the uk but I have a joint mortgage on a property in Dublin with an ex-partner. It was a new house and we weren't in it very long before we split up.  There is quite alot of equity in the property about (150000 euro) but he has begged me not to force him to sell.  he was really cut up about the break -up and I don't want him to lose his home.  he said he can re-mortgage and that he will give me 35000 euro now and a further 5000 pounds next year, however he wants the latter to be a private agreement just between us ie: no solicitors involved. I have contacted a solicitor in Dublin and he's been e-mailing me but he hasn't mentioned any fees or given me any advice....  I dont know what to do, also, Do I need to go to Ireland to swear a family home declaration or can things be sorted out from the UK????

Theres no reason why things cannot be sorted from your current location, although it may take much longer.

You do need solicitors involved, and this in unavoidable, as it is th e only legal way to get your name off the deeds once you have been bought out as the bank mortgaged the house to both of you and will want the legal handover to be handled properly..

Solicitors do not need to be involved him the payments you recieve, although be sure to get a payment plan in wiriting from him.

Any solicitor you approach for help will require payment, even if it has not been mentioned yet. Be sure to ask before accepting any advice.
