It is a recognised sleep disorder and easily provable/disprovable if this man does suffer from it.
Be assured....mightily assured....that there will be some Psychiatrist who will appear for the defense, stating that he is suffering from "Sexsomnia"

Would a statement from his recent ex GF to say this has happened before sway a jury? I am assuming the father didnt know he had this condition or he wouldnt have allowed him to sleep in an adjacent room to his daughter (mind you he allowed her to get drunk on cocktails?) And what is his relationship to the girl and father? Its all very strange, if his condition is recognised and proven beyond reasonable doubt I am not sure how I feel about this??

The statement from the ex is not really evidence, he would have to be diagnosed in a sleep clinic by a sleep disorder specialist.
daffy.....how would a sleep disorder clinic diagnose Sexsomnia, without observing the patient raping someone?

Perhaps they would have a nurse who would volunteer....

it is nonsense and brings mainstream medicine into disrepute.....in my opinion.

Yeah, so how can this be proved? Likely it can not... so I am intirgued how a jury would see this one?
Whilst I could accept that lying closely to someone could initiate this behaviour - the combination of walking from room to room does not seem reasonable to me.

Plus if you were aware of this 'condition' you would endeavour not to be in such a position.

Also "rape" is a general term which covers I would imagine several different unwanted/forced sexual acts. Are we thinking that this guy sleep walked, removed his trousers, aroused himself and then performed intercourse. Or did he for want of a better expression "touch her up" or rub up against whilst asleep?
I once woke up in the middle of a session with my oh, neither of us can remember who actually started it. lol
Rape is penetration (oral, anal or vaginal). TOuching her up or rubbing her would be charged as sexual assault.

Should I worry that I can tick off 4/5 of the 7 possible triggers for sexomnia???? More to the point should my GF!!

Thanks Barmaid I am not an expert on the subject. So ok, he has allegedly had full intercourse with the minor then.
It appears so JD. Having done a bit of googling it seems that this defence has been successful before (although there are not that many cases of it).
