Just received a phone call from my local custody suite from my son to inform me that he has been arrested for Taking Without Owners Consent (TWOCING). He said that 5 of them had been arrested but couldnt say more as the police told him that he couldnt discuss the case. My son cant drive so presumably he was a passenger.
Can anyone tell me the likely outcome at court for a passenger in this situation?

Being carried in a car knowing it to be stolen is an offence Nalit. My brother got done for it years ago, fine and points on licence.

Thanks EDDIE, I know its an offence just trying to find out what the punishment would be. Could it be anything more than a fine (probation etc)?
Dont understand the bit about points on license as he wasnt driving and has no license to put point on. Thanks again.
i don't think you have to have a licence to have points on (or be suspended)
My brother didn't have a licence at the time either. they gave him 'suspended' points to be added when he did a licence.

Well they shouldn't have done, Eddie! Taking a vehicle without consent can result in a period of disqualification from driving but can't result in the imposition of penalty points on a driving licence.

Assuming it was stranger's vehicle that was involved, Nailit, (rather than, say, hanging on to a hired vehicle beyond the agreed period) then the sentencing range if there was no damage to the vehicle (e.g. through breaking a lock) is from from a low level Community Order up to a high level Community Order. (i.e. there's no possibility of a custodial sentence).

If damage was caused to the vehicle (or if it was taken from private premises, rather than from the roadside or a public car park) the sentencing range is from a medium level Community Order up to 6 months imprisonment. However the 'starting point' sentence is a high level Community Order, so a custodial sentence is still unlikely under most circumstances.

Thanks Buenchico. As I said I dont have all the details yet because the police wouldnt let him discuss it on the phone with me so still a bit in the dark myself.

Just an update...
My son was arrested last night after travelling in a car being driven by his mate (along with others). The car crashed into a post and the driver was taken to hospital with leg injuries while the passengers, 2 of which legged it....2 of which were arrested (inc my son) are now requred to return to the custody suite for furthur questioning. (in a months time) The police have kept his clothing (turned up wearing grey police clothes) and he has "no commented' in interview, no solicitor.
Just thankful that he's still alive but where to go from here?

Hi EDDIE, no, his mum ended up paying. His fines were transferred to a debt collection firm and as he was under 18 at the time of conviction his mum ended up having to pay.

Oh dear - you really didn't need this. The bright spot is that he didn't run away. Has he a clue about the problems he is giving you? If not, tell him, please! I would think, given very limited experience, that he may get off with a warning and a fine.

It sounds to me as if it is time you made him grow up 'his mum bailed him out last time'. Bad as it is the old adage still holds true 'A stitch in time saves nine.'

I've taught in tough schools, as I think you know. The axiom in the staffroom was words to the effect that 'You are not doing them any favours by accepting behaviour that the world will not tolerate'. It was a good school.
