What would happen if the police tracked down a computer to an address where someone was viewing/downloading paedophilic material. The police decide that they should take action and raid the house, confiscate the computer and arrest the offending party.

What would happen if the offending party (the owner/user of the pc) was a 12 year old?

What could the police do?

If a child is 12 and is viewing pictures of other people the same age, should it be dealt with in the same way as a 35 year old would?

There are two issues to deal with in this case.  Firstly, one must remember how resourceful and tenacious 12 year olds can be in this day and age.  Children have and do steal credit card details, commit fraud and hack into banking systems so to access paedophile sites would be a doddle to some.

 

Secondly, as far as the law is concerned a child below the age of 10 has no criminal responsibility.  Between the age of 10 and 14 they have limited responsibility i.e. it is for a judge to decide as to whether the child knew that they were commiting an offence.  At the age of 14 one assumes full criminal responsibility.

 

In such a case as this(I guess we're talking hypothetically) IMHO the child should at least be monitored one way or another and should receive some form of counselling, psychiatric or otherwise.

What normal 12 year old wouldn't given the chance? I grew up in a one-bathroom, 7-kid family with a European mother. Nudity wasn't taboo. My 9-year old son sneaks a peek if he can, not that I frolick in front of him. I scold him but I don't freak-out. We're all naked under our clothes after-all, right? More concern should be put with those creating such material.

Just a natural 12-year old curiosity if you ask me. At least he's not coercing the neighborhood girls to strip! Shouldn't we focus on the creators of such material?

where does all this daily mail and follow onto sex education homework come from..and i quoted the boys that murdered james bulgar as 2 boys that murdered through warching nasty films..where do you think all the perverts come from. any person downloading child pornography regardless of age has a very sick perverted mind the poor child that is used in the film material is probably drugged and suffering what sort of people would even be curiouse to see such filth.and anyone looking at such things need help via counselling or other therapy..and yes i still go with my original thought if this downloading was intentional then the said child should go to a psychiatric unit and be assessed,,it may sound harsh but their are to many people getting away with to many things.and all peadophiles stem from one source or another..some people are very impressionable...mullein

a case simular to this just happened not far from where i live in pittsburg pennsylvania.  a 15 yo girl was sending naked pics of herself to guys and she got arressted for possession and distribution of child pornography.  it didnt matter that the pics where of herself,  she is in jail pending sentencing of up to 5 years in prison.  no matter what your age, child porn is child porn and should be prosecuted that way.

Justpassing, what the hell were you punishing your son for? Unless there's more to the story, he did not knowingly do anything wrong! It must have made NO SENSE to him whatsoever to be punished.
