He has been convicted of murder and his serving his sentence in jail.
It is not the norm to release people when they appeal or else evey murder would appeal and be back on the streets.
The appeal has to be proven and the sentence anulled before a murderer can be release. That is a long way down the line.

The appeal seems to hinge on the failure of his defence team to push for a manslaught charge rather than a murder charge. As he plead not guilty that is all rather academic.
Even if he had been convicted of manslaught he would still be in prison, and should not be released on the streets now.
If the murder conviction is overturn on appeal there will have to be a retrial and he will have to defend a prosecution for manslaught. Given the video evidence of the actually death, I doubt his defence will be any easier the second time around.

There's lots more to this case than we've seen in the media.
He broke the Geneva Convention but in the end all these things should be tried under military Courts Martial not civilan courts at a push the ICC for the breach of the Geneva Convention. He would face the exact same level of justice and punishment and our armed forces would not face the continued humiliation from the media for the job they do. All cases like this do is give the PC Brigade more and more ammunition to attack our forces.
Let the forces judiciary deal with it, he'll be just as guilty

Fair enough gromit, if he's been through the courts Martial Appeal then it's his problem and he needs to serve whatever penalty is confirmed by the appeal courts.
Our military, through our training and doctrine set a very high bar in terms of conduct, if that breaks down it makes us no better than the enemy.
