Either we are sure enough for someone to be punished, or we aren't. Hopefully nowadays, we can also get 100% certainty, where necessary.
Your total mistrust in the justice system, is very common, but also shows why people are freed to kill again, by mistake.

It involves judgement calls, and of course, they don't always pan out.
For me, the absence of the barbaric practice of execution covers the factor that an innocent person will not die for a crime they did not commit.

As pointed out by New Judge elsewhere he has pleaded guilty to all charges
No risk to any innocent person in this case
Lots of debate too about previous miscarriages of justice
Again moot but especially in the last 20 years as a result of DNA and documentary evidence from phones and cctv etc

This person killed someone, a heinous crime, truly hideous. What can we do to punish them? Oh, let's kill them! It's different when we do it. More ... justifiable.
Oh no, I wouldn't chop off a thief's hand, that's barbaric and may be painful. But kill a murderer? Yep, that's OK.
It's not right for people to be able to take their own lives when they're terminally ill, critically disabled or in a lot of chronic pain. The state must try everything to keep them alive. But the state killing a murderer? Yep, that's OK.
I know I call the Taliban barbaric for killing people who break their laws. But it's because their laws are different to ours, not because I think killing people is barbaric.
