AH, you won’t bother answering me? You just did. :o)
Corby, I don’t think capital punishment was ever a deterrent to murder. It certainly ensures that there’s no repeat performance though.
// The deterrent argument is almost certainly bogus.//
yeah I am not sure the average PC says 'foo I better not do what Couzens did, or I ' ll get a whole life tariff - wow!" or eek!
Deterrent.... implies somebody is punished to prevent others doing the same. That clearly isn't right. If it puts off an individual, great. But any punishment shouldn't be about "others".
NAOMI, is there a 100% certainty that no innocent person would ever be hanged?
No, Corby, just as there is no certainty that offenders won’t take an innocent life again.
Is the punishment worth the risk of the State murdering an innocent person?
Is keeping a murderer alive worth risking other innocent lives? It’s happened.
TCL, I gave a short list on the other thread... which, of we have it wrong, still means we have totally destroyed several lives.
Either we are sure enough for someone to be punished, or we aren't. Hopefully nowadays, we can also get 100% certainty, where necessary.
Your total mistrust in the justice system, is very common, but also shows why people are freed to kill again, by mistake.
Whatever the problem is... is about justice, not sentencing.
Corby - // Is the punishment worth the risk of the State murdering an innocent person? //

It involves judgement calls, and of course, they don't always pan out.

For me, the absence of the barbaric practice of execution covers the factor that an innocent person will not die for a crime they did not commit.
It isn’t going to happen - ever - for countless reasons, so it’s all a bit pointless :-)
With advances in forensics methods of crime detection these days I don’t believe it involves judgement calls. That’s how it used to happen - but no more.
It has changed, hugely, from olden days.
Is DNA evidence 100% reliable?
99.9%. But, it's only used alongside other evidence anyway. So- pretty much, yes.

Is the punishment worth the risk of the State murdering an innocent person?

Moot point
As pointed out by New Judge elsewhere he has pleaded guilty to all charges
No risk to any innocent person in this case
Lots of debate too about previous miscarriages of justice
Again moot but especially in the last 20 years as a result of DNA and documentary evidence from phones and cctv etc
This person killed someone, a heinous crime, truly hideous. What can we do to punish them? Oh, let's kill them! It's different when we do it. More ... justifiable.

Oh no, I wouldn't chop off a thief's hand, that's barbaric and may be painful. But kill a murderer? Yep, that's OK.

It's not right for people to be able to take their own lives when they're terminally ill, critically disabled or in a lot of chronic pain. The state must try everything to keep them alive. But the state killing a murderer? Yep, that's OK.

I know I call the Taliban barbaric for killing people who break their laws. But it's because their laws are different to ours, not because I think killing people is barbaric.

And so on ...
// I don’t think capital punishment was ever a deterrent to murder. It certainly ensures that there’s no repeat performance though.//

um so - - there were no serial murderers when they had capital punishment? I seeeee--- very interesting ( thx to Rowan and Martin)

I am not sure how many murderers on licence er re-murder

wonky stuff in full flow on AB today I notice
good one lipsey
Ellipsis//It's not right for people to be able to take their own lives when they're terminally ill, critically disabled or in a lot of chronic pain//

That may be worth a different thread, but I can't imagine many would agree it "isn't right".
