If convicted under the rules of joint enterprise all will go down as murderers. While it's difficult to have any sympathy with them, those who engaged in horseplay and now find themselves facing murder charges must feel themselves hard done by.
Any thoughts?

Poor Mr Kirwan, he was very brave to tackle a bunch of feral youths, as this often ends badly. Law and order has gone to pot in this country now and they will probably have the best defence available to them while Mr Kirwan's family will never see him again.

Let's imagine, just for the sake of argument, that one or more of the accused were up for a bit of vandalism/horseplay but had no knowledge of a knife being carried by one of their number, or that it would be used.
How could they prove that and why should they have to?
What happened to the idea that an accused person doesn't have to prove their innocence?

we are trying 'to decide' if someone is dead then it attracts criminal charges.

But my efforts have failed Naomi - - the fact they are dead does not mean a certain charge ( murder ) is er certain.
Murder , Manslaughter, Infanticid, Mandslughter by gross negligence, lawful homicide - all spring to mind.
