for leaders of hamas in gaza and for two members of israel's government on the suspicion that they have committef war crimes

https://www.bbc.com/news/articles/cw4490z75v3o

both sides have naturally claimed that only the other should be prosecuted

the ICC prosecutor said:

"No foot soldier, no commander, no civilian leader - no one - can act with impunity." The law, he says, cannot be applied selectively.  If that happens, "we will be creating conditions for its collapse"."

an excellent and principled statement that is very difficult to disagree with. is there hope for the rules-based order yet?

I doubt it very much. The eventual losers need to watch out though.

Outrageous assertions, the ICC is a busted flush;

 https://archive.ph/bqCGj

Then the ICC has lost all credibility.

these are the most outrageous anti-semitics sentiments - the idea that Gazans are starving let alone being starved - that there are any dead Gazans AT ALL - besides terrorists, but who cares about them even there are 1m. ( terrorists, not dead, lets be accurate about this!)

and the mods should not whicker and wonder , shilly shally, and pussy foot about but delete the whole thread IMMEDIATELY !

The victors write the histories - is certainly from the Second world war, and in Germany (oops!) well before - as a leitmotif ( oops oops) in nineteenth century lit

Peter - When any Moderators need advice from you, we'll give you a shout.

Hint - don't hold your breath ....

There are lots of accusations that an international court would want to investigate, but any warrant is likely to remain unapplied. Those named can easily remain in their own country in this modern technological world. Israel isn't even signed up to the ICC. Their biggest ally isn't either.

Plus this is only at the application stage. Nothing decided yet.

thank you andy for your kind thoughts. bit inappropers for a war crimes thread - but hey this is AB ! ( and you're a mod)

The KC on R4 - said that the IDF had a right to self defence but also had to follow the rules of war and not their own. It was obvious ( I think he may have sniggered) that the population of Gaza was starving and it was getting worse

Plus this is only at the application stage. Nothing decided yet.

oh this is all ya-ya isnt it? - all said an done, not a morsel not a calorie more will reach a starving Gazans mouth as a result.

Shame on..... never mind or I will get deleted

Like I've been saying all along, there have been atrocities on both sides. It's just seems that many here are only too happy to turn a blind eye to half of them.

oh hang on mozz, somebody will be along to make a comment about October soon.

it appears to me that the international community (if not the AB community are losing sympathy a little for israel

Question Author

I completely agree mozz

the icc must surely be willing to investigate claims against both sides if they are to have any legitimacy? what's funny is that both hamas and the israeli government sound exactly alike in their spluttering refusals to co operate or admit they've done anything wrong.

"Plus this is only at the application stage. Nothing decided yet."

this is of course true it's very unlikely indeed that these requests will be refused in my opinion... the prosecutor is not going to request arrest warrants if he thinks he cannot get them

if one takes the time to actually read his statement and do so objectively then it's very difficult to dispute his reasons

Hmm.   ""

Khan accuses them of starving Gaza’s civilians, wilfully killing them, intentionally attacking those queuing for food and obstructing delivery of humanitarian aid. He says Israel has “intentionally and systematically” deprived Gaza’s civilians of objects indispensable to human survival through “the imposition of a total siege over Gaza that involved completely closing the three border crossing points … for extended periods”.
But the very opposite is the case. There has been no “total siege”. Since the beginning of the war, according to Israeli statistics, 18,255 trucks have crossed from Israel into Gaza carrying 399,580 tons of food, 59,660 tons of shelter equipment and 23,110 tons of medical supplies.
It is Hamas that has been obstructing the delivery of aid and stealing civilian supplies for its own use and to sell on the black market at inflated prices, from which it is estimated to have made some $500 million, according to an analyst at the Washington Institute and supported by Shin Bet, Israel’s domestic security agency. When Israel has opened fire around the aid trucks it has been against Hamas terrorists trying to steal their cargo.""    ...   The Times.

Well said Togo.

bednobs //it appears to me that the international community (if not the AB community are losing sympathy a little for israel//

Perhaps if you were to read a wider selection of the world's press, you would find this isn't true at all.

As I've said before, the whole issue of Gaza is just a continuation of the thousands of years of animosity between Jews and Arabs. Say what you like, whatever you like, but they'll still be at each other in thousands of years to come. Unless of course they both want it to end. Is that a possibilty? Mmmm.

the prosecutor is not going to request arrest warrants if he thinks he cannot get them

no I think it may all be a show -  trial - BUT as with Mugabe it does make it difficult for foreign travel and showing off as a high-up ( Netanyahu that is!)

Did you hear of a prime ministers measured and dignified response? - "disgusting that a serving Prime Minister, duly elected by a democracy should face criminal charges....."- - hold it Benjy - you are being indicted for fraud, arent you?

Perhaps if you were to read a wider selection of the world's press.... yeah I agree with that one

everyone disputes the IDF are there at all, whether they have killed anyone altho taking casualties themselves

and the idea of feeding an occupied area is fanciful wonderland. let alone giving them water and bogs that flush
