Stupid question I know, but how do you about getting your hospital records?
My son who was attacked and left for dead- well I have got him a solicitor on a no win no fee basis and he has all the photos so far, but need his hospital records. I’ve never ever done this so how do I (or my son) do this? X

Sorry, Corbyloon, I thought your post was by Tony.
smow as I mentioned earlier you GP will have been sent a copy, this may be a quicker and easier route.
hc can get confusing when posts cross lol we digress, not unusual here.
Under the previous Data Protection Act quoted on the form, information had to be provided within forty days of a request and that's what I was thinking on.

Under the GDPR it now normally has to be given within thirty days of the request.

It sounds like the hospital keep records on site for forty days and anything older is sent to storage.

Sorry guys had to rush off. To be fair I’ve just re read his email and it says he needs his hospital records and any previous convictions - I just assumed that he wanted me to find the records as I’ve never done this before.
Previous convictions?
don't get the solicitor to get them, get them yourselves.
slightly confused - from whom is he hoping to get money? If it is known who did it, they will be prosecuted and he ill get compensation. If it is not know doesn't CICA apply?
smow it is called a CRB check do not know which one your son will need as there are 3 different types. Details here.

meant to add I would imagine it is just a basic one he needs.
I do hope that your son is not using a solicitor to claim for compensation from the Criminal Injuries Compensation Authority - it is so easy for him to do it himself and he can claim online.
Why would Smow's son need a CRB check?
you can request them but may have to pay, if you get your doctor to request them he shouldn't have to pay, we do this a lot in my hospital.
ummmm I do not know, I am just giving answers to the questions smow is asking.

I assume to to do with a court case to see if he has any convictions for violence. I am sure it it will come back clear.

ummmm it is not the check it is the information.
The question doesn't hang together no wonder the answers are so mixed - hopefully Smow is a bit clearer now.
Yes, if you make a claim for compensation through CICA they need to know about your unspent convictions.

It worries me that Smow's son is using a solicitor as he will not be able to claim the solicitor's costs and it will come out of his compensation. I might not be cheap and it is so easy to claim himself.
Oh...I didn't know that.

TonyV - I just thought is was an error.
I agree Hc, far better to use this avenue.

By the way, CICA will obtain the DBS check - the solicitor just wants to know whether or not he's wasting his time if Smow's son has just come out of prison for GBH. (for example)
I'll say it again - using a solicitor could be VERY expensive for Smow's son. He will have to pay if he wins.
