who would be a at fault if we had collided?

a coule of weeks ago, i was parked at the side of the road in designated bays that do not block the road at all...just behind me was a bus stop, which is not a bay sort, so the bus blocks the traffic for a moment...

as the bus had only just stopped, the way was clear for me to pull out...i checked my mirrors and there was no car beside the bus....so i pulled out...but as i did a car overtook the bus and flew round into my lane.

we didnt collide but they beeped me...

to my mind, i have right of way here and i cant be expected to know that they are going to overtake the bus...i know they might do, but i cant sit and wait on the offchance ... you could not see a car overtaking from where i was, until its out the other side so itd have made no difference anyway...

surely they should have been aware that there may have been a vehicle in front of the bus and been ready to pause...
they are the ones performing a manouvre and moving into the wrong lane.

but if theyd hit me...who would have been blamed?

i think them...but am i wrong?

i am amazed that i am not allowed to pull out into a clear lane, both behind and infront, because someone might decide to perform an manouvre that is unsafe...!!?

i am supposed to guess they might do this...

it is the same, the vehicle travelling is passing an obstruction on your side and the driver is making the judgment that he can proceed to the end of the obstruction safely. that can happen in the exact same circumstance as yours. If I am behind a bus and the bus pulls over at a stop and I can see that road ahead is clear and that there is no oncoming traffic, I have a right to proceed with caution. any vehicle in front of the bus that decides to pull out when there is a bus behind them and they have 'blind spots' (your words) should not make any kind of manuvre until it is completely safe to do so

Joko, absolutely nothing personal and I am tring to give you some good advice but it seems you just want someone to tell you that you are right and I cannot do that I am afraid. If I were the investigating officer (should there had been a collision) I would e probably be holding you responsible and that's all I can say.

Please just put it down to an experience that has escapedinjury and think about it the next time you are in a similar position.

kakurol...i want proper answers thats all...most of the ones so far have been a snide attack or the result of scan reading the situation

no-one has yet actually explained why this person was totally justified in what they did and i am totally wrong.

i would like genuine - and convincing - answers from people who have clearly read the posts properly because if anyone can properly show me i an totally wrong then i will know for future reference

peeler pal...thankyou for you input, but i dont think you have given me any advice at all, good or bad...you appear to twice now totally misread the post and misunderstood the situation, so forgive me if i cannot just take your word on this...

for all this other driver knew there could have been 5 or 6 cars in front of the bus...you cannot see from behind the bus because of the angle of the road...

i have never see anyone else overtake at this point, and i never do either...

are you saying i am not allowed to pull out onto the highway in front of a stopped car...just in case some else else tries to quickly jump into the gap?
